Terms of Use

This is a courtesy translation; in case of discrepancy, the French version prevails.

These Terms of Use (“Terms”) govern the use of the Menu Semaine mobile application (“the Application”) published by BAUGEY MATHEO (DEVOLIM). The terms of sale and subscription for the Menu Semaine Premium offer are set out in the Subscription Terms, which supplement these Terms.

Any use of the Application implies full and complete acceptance of these Terms.

2. Definitions

• User: any natural person who installs and uses the Application.
• Anonymous identity: an anonymous technical identifier, created automatically and tied to your device, with no account or login credentials.
• Free version: access to the organisation features (weekly planner, recipe book, shopping list) and to part of the artificial intelligence features through tokens, without ads.
• Tokens: free usage units, with no monetary value, that allow the artificial intelligence features to be used in the free version. Their allowance, their renewal and the cost of each action are shown in the Application and may change. They cannot be bought, exchanged or refunded.
• Menu Semaine Premium: paid subscription offer that extends the use of the artificial intelligence features and gives access to additional features (see Subscription Terms).
• Platforms: Apple's App Store and Google's Play Store, through which the Application is distributed and Premium is sold.

3. Acceptance and duration

These Terms take effect as soon as the Application is installed and apply for the entire period of use. The publisher may amend them at any time; the applicable version is the one in force at the time of use, available at https://menusemaine.devolim.fr/cgu.html.

4. Description of the service

Menu Semaine is a meal organisation application. In particular, it lets you plan the week's meals, manage a recipe book, keep a shopping list and follow nutrition benchmarks. At the User's request, it also offers artificial intelligence features brought together under the name of the assistant Yumi (meal planning, recipe from the leftovers in your fridge, answers to questions about a recipe, shopping list, estimates). Part of these features is available in the free version through tokens; the Premium offer extends their use. The artificial intelligence features remain subject to a reasonable usage limit intended to prevent abuse.

5. User account

Using the Application does not require any account: an anonymous identity, tied to your device, is created automatically on first launch, with no email or password. Your content (menus, recipes, shopping lists) is stored locally on your device. Data processing is described in the Privacy Policy.

6. Conditions of use

The User undertakes to:

• use the Application in accordance with its intended purpose and the laws in force;
• not attempt to circumvent technical limitations (in particular those of the free version, the tokens or the AI usage limits);
• not use the AI features to generate content that is unlawful, dangerous or diverted from its culinary purpose;
• not disassemble, decompile or attempt to reproduce the Application's source code;
• not rely exclusively on the Application for decisions relating to their health or diet.

7. Premium offer

The App may offer a paid option (auto-renewing subscription and/or in-app purchase) giving access to additional features. The nature of the offer, its price, its duration, its renewal terms and, where applicable, whether a free trial is offered and for how long, are shown in the App and by the Platform (App Store or Google Play) before you confirm any purchase; this information may change and the version displayed at the time of purchase prevails. Payment is made through your Apple or Google account. Unless cancelled at least 24 hours before the end of the current period, the subscription renews automatically for the same period. It can be cancelled at any time from your Apple or Google account settings; cancellation takes effect at the end of the current period. The full terms (payment, renewal, cancellation, restoration, withdrawal, refund) are set out in the Subscription Terms. In accordance with Article 293 B of the French General Tax Code (CGI): VAT not applicable.

8. Intellectual property

The Application, its code, its interface, its brand and its original content are the exclusive property of BAUGEY MATHEO. Use of the Application grants a personal, non-exclusive, non-transferable right of use. Any reproduction, distribution, reverse engineering or commercial exploitation is prohibited.

The content you create (recipes, menus, shopping lists) belongs to you and remains stored on your device. For the artificial intelligence features you use only, you grant DEVOLIM a limited technical licence, strictly necessary to transmit this content to our AI provider for the time needed to generate the requested result, under the conditions described in the Privacy Policy.

9. Legal guarantees

The User benefits from the legal guarantees applicable to digital content:

• the legal guarantee of conformity (Art. L.224-25-1 et seq. of the French Consumer Code);
• the guarantee against hidden defects (Art. 1641 et seq. of the French Civil Code).

10. Limitation of liability

• suggestions, recipes and estimates (particularly of calories) are indicative and cannot engage the publisher's liability with regard to decisions taken by the User;
• the publisher cannot be held liable for unavailability due to maintenance, third-party services (Firebase, OpenAI, Apple, Google), residual bugs or hardware incompatibilities;
• in accordance with Article 1231-3 of the French Civil Code, the publisher's liability is limited to direct and foreseeable damage.

Nothing in these Terms limits the publisher's statutory liability in the event of gross negligence or fraud, nor the consumer's mandatory rights.

11. Personal data

Data processing is described in our Privacy Policy. In short: Menu Semaine works without an account (anonymous identity), your content is stored locally on your device, the app shows no ads, and you can delete all your data at any time from within the app.

12. Termination and data deletion

You may stop using the Application at any time. Deleting your data (Settings → Account → “Delete my account”) permanently erases your content stored on the device as well as the residual server-side data (subscription status, token balance and usage counters). Uninstalling the Application or deleting your data does not cancel an active Premium subscription: the subscription is cancelled from your Apple or Google account (see Subscription Terms).

13. Consumer mediation

In accordance with Articles L.611-1 et seq. of the French Consumer Code, a consumer User may use a consumer mediator free of charge. European online dispute resolution platform: ec.europa.eu/consumers/odr.

14. Governing law and jurisdiction

These Terms are governed by French law. In the event of a dispute, after an attempt at amicable resolution, the French courts shall have jurisdiction; a consumer User may bring proceedings before the court of their place of residence.
